Where to look for residential pool fencing laws in LA
Start with section 3109 of the Los Angeles Building Code. It was updated in 2020. The previous update was in 2017, so if history is any predictor of how often the regulations are updated, they are due to be reviewed soon.

What needs a pool enclosure?

In Agoura Hills, every swimming pool, fishpond, or other body of water 18 inches or deeper needs to be enclosed.
Do you need a separate permit from the city for the pool enclosure?
No, you don’t. But this section is misleading. The first sentence of this section, actually Section !V, paragraph 2, states you do. Read further, though. You only need a permit if the fence is constructed of concrete or masonry of 3.5 feet. The enclosure, however, must be part of the plans you submit for your pool to the city building department.

How high does the pool enclosure have to be?
The enclosure surrounding a pool has to be at least five feet (sixty inches) in height. This measurement is made on the side facing away from the swimming pool.
What about ground clearance?
The bottom of the fence is allowed a maximum of two inches of clearance between the ground and the fence. As with pool height, this is measured on the side facing away from the pool.

What else about the fence do I need to know

  • The outside of the fence must be free of “protrusions, cavities, or other physical characteristics” that kids (five and younger) can use to gain a handhold or foothold and climb over.   • Gaps in the fence between components must be such that a sphere or ball over four inches cannot pass through.
  • If the fence consists of horizontal and vertical members and the distance between the horizontal members is less than 45 inches, those members must be located on the swimming pool side of the fence. If you are having trouble imagining this, just be mindful that horizontal components of the fence can be used as ladders if they are accessible from the outside.
  • If the fence consists of horizontal and vertical members, spacing between the vertical members shall not exceed 4 four inches. In fences with decorative cutouts, the maximum space allowed within the cut-out is 1-¾” inches wide.
  • In lattice-style fencing, where the fence has intersecting diagonal members, the holes or cavities formed by those lattices can be no more than 1-¾ at their widest.
  • Access gates through the enclosure created by the fence shall open away from the pool.
  • Access gates shall be self-closing and self-latching.
  • The latch device must be at least 60 inches above the ground.
  • Always check with the municipality. Swimming pool fence requirements in Los Angeles and any other municipality or jurisdiction are constantly being updated.
